This clause doesn’t prevent you from bringing issues to the attention of federal, state, or local agencies—they can pursue action on your behalf if they choose. It also doesn’t prevent us from seeking injunctive relief in court to protect our intellectual property or prevent terms violations.
Severability
If any provision of these terms is found unlawful, void, or unenforceable by a court, that provision is modified to the minimum extent necessary to make it enforceable, or severed entirely if modification isn’t possible. The rest of the terms remain in full force and effect.
For example, if a court rules our arbitration clause unenforceable in a particular jurisdiction, disputes in that jurisdiction would proceed in court per the Governing Law section above, but arbitration would still apply elsewhere.
Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and Omnitrix regarding use of this website. They supersede any prior agreements, communications, or understandings (written or verbal) about this subject matter.
No waiver of any term is effective unless in writing and signed by Omnitrix. If we don’t enforce a provision on one occasion, that doesn’t mean we’ve waived the right to enforce it later.
